Counselling Confidentiality

General Guidelines

In general, it is a counselor's primary obligation to protect the client's disclosures as a vital part of the therapeutic relationship. When assuring clients that what they reveal in sessions will generally be kept confidential, counselors should also tell them of any limitations on confidentiality. This practice does not necessarily inhibit successful counseling.

Following are some of the circumstances that dictate when information must legally be reported by counselors:

• when clients pose a danger to others or themselves;
• when the therapist believes that a client under the age of 16 is a victim of incest, rape, child abuse, or some other crime;
• when the therapist determines that the client needs hospitalization;
• when information is made an issue in a court action;
• when clients request that their records be released to themselves or a third party.

Limitations of Confidentiality:

1. the need to keep records;
2. the requirements of professional supervision;
3. where others need to be protected;
4. when working in conjunction with other professionals;
5. in cases where the law requires disclosure in information.

If or when any of these circumstances exist, the counsellor will inform the counselling client of the circumstances and need to disclose information.

The above Confidentiality Guidelines apply to all counsellors working in or in conjunction with this practice.
